Terms of Use
The terms on which Digital Sphere Limited provides Landsight. Please read them: by using Landsight you agree to them.
Last updated 2 November 2026
1. About these terms
Landsight is property intelligence, development feasibility and design software for New Zealand, provided by Digital Sphere Limited, a New Zealand company (“we”, “us”). These terms apply to the Landsight website and web app, and to Landsight’s connector for AI apps. An organisation may also have a separate written agreement with us; where it differs from these terms, that agreement applies. Our Privacy Policy explains how we handle personal information.
2. Accounts
- Give us accurate details, keep your password to yourself, and tell us through the contact form if you think someone else has used your account.
- You are responsible for what is done with your account. An organisation is responsible for who it invites and the role it gives each person.
- You must be 18 or over to use Landsight.
3. Plans, payment and cancelling
- Starter is free. Premium and Enterprise are described on the pricing page. Prices are in New Zealand dollars and include GST.
- Premium is paid for in advance, monthly or yearly, through Stripe, and renews automatically at the end of each period until it is cancelled. Stripe holds your card details; we never see them. Your bank statement says LANDSIGHT, and your receipt names Digital Sphere Limited.
- You can cancel at any time in Plans & Billing. Your plan then stays until the end of the period you have paid for, and your organisation moves to Starter. We do not refund part of a period, except where the law requires it.
- If a payment fails, your plan continues for 7 days while the payment is tried again and you can update your card. After that your organisation moves to Starter until it is paid.
- We may change our prices by telling subscribers at least 30 days beforehand by email. A change takes effect from your next billing period after the notice ends.
- Each plan’s reports, AI allowance and other limits are those shown on the pricing page. Enterprise includes fair-use limits on AI.
4. What Landsight’s reports are
- Reports, feasibilities, cost estimates, layouts and AI answers are preliminary information to help you decide what to look into. They are not legal, planning, engineering, valuation, tax, financial or investment advice, and they are not a LIM, a survey, a title search, a registered valuation or a building or resource consent.
- Landsight reads records from Toitū Te Whenua LINZ, councils, Watercare, the Ministry of Education, OpenStreetMap and other sources, under their licences and with their credits. Those records can be out of date, incomplete or wrong, and we do not control or guarantee them. Where something was not checked or could not be read, Landsight says so; that it says nothing about something does not mean there is no issue.
- A rating value is set for council rates. It is not a market price, and a figure read from the web is labelled as that and has not been verified by us.
- Check anything you rely on with the council and with a qualified professional before you buy, build, borrow or commit.
5. AI
- Some features use artificial intelligence. AI can be wrong, and an answer may need checking against its sources. You are responsible for what you do with it and for anything you publish or send.
- Do not rely on AI for a decision about a person’s legal rights or safety.
6. Your information in Landsight
- What you keep in Landsight remains yours. You give us permission to store, process, back up and display it only to provide Landsight to you and to the people you choose to share it with.
- You are responsible for what you upload and share, and for having the right to do so.
- When an account or subscription ends, you can ask us through the contact form for a copy of your records within 30 days. After that we may delete them, except where the law requires us to keep them.
7. Using Landsight properly
You must not:
- use Landsight for anything unlawful, or to harass or harm anyone;
- try to get into accounts, records or parts of Landsight you have not been given, test its security without our written permission, or interfere with how it runs;
- copy, scrape, bulk-download or resell Landsight, its reports or its data, or get around its limits, including through its connector for AI apps;
- upload anything harmful, or anything you have no right to.
We may suspend an account that breaks these terms or puts other people or Landsight at risk. Where we can, we will tell you first and give you a chance to put it right.
8. Our service
- We work to keep Landsight available and secure, and to fix problems promptly, but we do not promise it will always be available or free of errors. We may need to take it offline briefly for maintenance.
- We improve Landsight over time and may change or retire features. We will tell subscribers before we remove anything they rely on.
9. Intellectual property
Landsight, its software, design, name and logo belong to us. Using Landsight gives you no rights in them beyond using Landsight under these terms. Data from other sources stays under its own licence.
10. Liability
- If you use Landsight in trade, as developers, investors, agents and other businesses do, you agree that the Consumer Guarantees Act 1993 does not apply, and, to the extent the law allows, that sections 9, 12A, 13 and 14(1) of the Fair Trading Act 1986 do not apply, and that this is fair and reasonable.
- If you use Landsight as a consumer, nothing in these terms limits your rights under the Consumer Guarantees Act 1993 or the Fair Trading Act 1986.
- To the extent the law allows, we are not liable for indirect or consequential loss, or for loss of profits, revenue or data, and our total liability to you in any 12 months is limited to the fees you paid us in those 12 months.
- Nothing in these terms limits liability that the law does not allow to be limited.
11. Ending
- You can close your account at any time by asking through the contact form.
- We can end a subscription with 30 days’ notice, or straight away if a subscriber seriously breaches these terms or does not pay what is due. If we end it without a breach, we will refund what you paid for the time remaining.
12. Changes to these terms
We may update these terms. We will show the date of the latest version at the top, and tell subscribers by email at least 30 days before a change that affects them takes effect. Continuing to use Landsight after that means you accept the change.
13. Law
These terms are governed by New Zealand law, and the courts of New Zealand have jurisdiction.
